법령 제408/2016호에 대한 개정안 – 현행 법령의 변경 분야: • 지난 몇 년간 확인된 명백한 결함의 시정. • 국제 권고안, 특히 국제원자력기구 권고안의 새로운 내용과 관련된 조정. 여기에는 고위 경영진의 역할, 고위 경영진의 업무, 불일치 관리 및 경영시스템 변경 이행 분야의 권고안이 포함된다. • 국제 관행의 변화와 관련된 변경, 최근 몇 년 동안 체코뿐만 아니라 전세계적으로 프로세스 및 활동과 그 산출물, 즉 특정 장비, 원자력 시설 구성품과 같은 품목에 대한 품질 보증에서 특정 결함(소위 부정 품목)이 적발되고 있다는 사실에 대한 대응. 부정 품목은 품질 저하로 이어져 원자력 안전, 방사선 방호, 기술 안전, 방사선 감시, 방사선 사고 관리 및 보안 등 안전 보장에 영향을 미칠 수 있기 때문에 원자력 분야에서 매우 심각한 문제이다. • 계획된 신규 공급원 및 그 건설과 관련된 조정. 신규 공급원은 아직 실제로 구현되지 않았거나 이미 구현된 원자력 시설 프로젝트의 활용에 의존하는 기술을 상당 부분 활용하지만 여러 가지 새로운 개발이 필요하다. 이러한 맥락에서, 원자력 시설 건설 시 허가된 활동 및 관리 시스템에 대한 문서의 통일된 명확성을 보장하고, 모든 관련 기관이 이해할 수 있는 단일 커뮤니케이션 플랫폼 또는 공통 언어를 확보해야 하는 등의 새로운 요구사항(또는 가정)이 있을 수 있다. • 안전 문화 요구사항의 수정 – 안전 문화에 대한 더욱 자세한 요구사항을 명시한 제13조 조항의 완전하고도 포괄적인 개정. • 허가 대상 활동 관련 문서 또는 관리 시스템 관련 문서의 수정. 문서 작성 방법, 문서 내용 및 접근 방법 명확화(특히 관리 시스템 시행 기관이 원자력 에너지 사용 관련 활동 허가 소지자인 경우). 현재 개정 중인 법령 제408/2016호는 유라톰 지침(이사회 지침 2009/71/ Euratom, 이사회 지침 2011/70/ Euratom, 이사회 지침 2013/59/ Euratom, 이사회 지침 2014/87/ Euratom)의 일부 조항을 체코 법규에 도입한다.

Draft amendment to Decree No 408/2016 – areas of change in the current text of the Decree: • Correction of evident defects that have been discovered over the course of previous years. • Adjustments related to novelties in international recommendations, in particular those of the International Atomic Energy Agency. These include recommendations in the area of the role of senior management, the tasks of senior management, recommendations in the area of managing discrepancies and implementing changes to the management system. • Changes related to changes in international practice, reaction to findings that quality assurance for processes and activities and their outputs, i.e. items such as selected equipment, components of nuclear installations, in recent years not only in the Czech Republic, but also globally, suffers from certain shortcomings and so-called fraudulent items are being detected. Fraudulent items are a highly critical problem in the nuclear field as they can lead to quality degradation and consequently to impacts on safety assurance, i.e. nuclear safety, radiation protection, technical safety, radiation monitoring, radiation incident management and security. • Adjustments in connection with planned new sources and their construction. New sources will to a significant extent make use of technologies that have not yet been implemented in practice, or that depend on the use of already implemented nuclear installation projects, but with a number of new developments. In this context, we can mention, for example, the new requirement (or rather assumption) that the construction of nuclear installations should ensure uniform clarity of documentation for the permitted activity and for the management system, a single communication platform or common language that is comprehensible to all entities involved. • Modification of safety culture requirements - a complete and comprehensive revision of the provisions of § 13, which sets out more detailed requirements for safety culture. • Modification of documentation for activity being permitted or the documentation for the management system. Clarification of how the documentation is to be formulated, what it is to contain and how it is to be accessed, in particular where the entity implementing the management system is at the same time the holder of a permit an activity involving the use of nuclear energy.Decree No 408/2016, which is currently being amended, introduces into the Czech legal code some provisions of Euratom Directives (Council Directive 2009/71/Euratom, Council Directive 2011/70/Euratom, Council Directive 2013/59/Euratom, Council Directive 2014/87/Euratom).
