제품 및 물품의 품질에 관한 법률은 제품 및 물품을 생산하고 거래하는 단체와 개인, 그리고 제품 및 물품의 품질과 관련된 활동을 하는 단체와 개인의 권리와 의무를 규정한다. 제품 및 상품의 품질에 관한 법률은 베트남에서 제품 및 상품을 생산하고 거래하는 단체와 개인, 그리고 제품 및 물품의 품질과 관련된 활동을 하는 단체와 개인에게 적용된다. 이 법률 초안은 다음과 같이 제품 및 물품의 품질에 관한 법률의 여러 조항을 개정, 보완, 추가 및 폐지한다. 1. 다음 조항의 보완 및 개정: 3, 5, 6, 7, 10, 11, 12, 14, 16, 17, 26, 27, 28, 31, 34, 35, 36, 37, 40, 45, 47, 48, 68, 69, 70 2. 다음과 같은 조항의 신규 항목: - 국가 품질 인프라에 관한 조항 7a - 제품 및 상품의 품질 관리에 있어서 기술의 적용에 관한 조항 7b - 국가관리 목적의 적합성 평가에 관한 조항 25a Assessment of conformity for state management purposes 3. 폐지: - 제15조 12항의 “37항에서 규정된 수입품 품질검사 비용 및 수수료 납부”에 관한 규정 - 제7조 19항의 “37항에서 규정된 수입품 품질검사 수수료 징수”에 관한 규정 - 제2조 및 제3조 37항, 44항 및 제3조 66항에 관한 규정 경과 규정 1. 제품 및 상품이 이 법률의 시행일 이전에 결정문, 적합성 선언 서류 접수 통지서, 적합성 인증서에 명시된 유효기간 내에 제조, 수입, 유통되고, 제품 및 물품의 품질에 관한 법률의 규정에 따라 관리된 경우, 해당 제품 및 물품은 계속해서 시중에 유통될 수 있다. 2. 적합성 평가 기관이 이 법률의 시행일 이전에 제품 및 상품의 품질에 관한 법률 조항에 따라 적합성 평가 활동을 등록했거나 국가관리 업무를 수행하도록 지정된 경우, 인증서 또는 지정 결정에 명시된 유효기간이 종료될 때까지 계속해서 사업을 유지할 수 있다.

This draft Law amends, supplements, adds and abolishes a number of articles of the Law on Product and Goods Quality, as follows: 1. Supplement and amend the following Articles: 3, 5, 6, 7, 10, 11, 12, 14, 16, 17, 26, 27, 28, 31, 34, 35, 36, 37, 40, 45, 47, 48, 68, 69, 70 2. New entry of the following Articles: - Article 7a on National Quality Infrastructure - Article 7b on application of technology in product and goods quality management - Article 25a. Assessment of conformity for state management purposes 3. Abolishing: - Regulations on “Paying costs and fees for inspection of imported goods quality as prescribed in Article 37” in Clause 15, Article 12. - Regulations on “Collecting fees for inspection of imported goods quality as prescribed in Article 37” in Clause 7, Article 19. - Regulations on Clauses 2 and 3, Article 37, Article 44 and Clause 3, Article 66. Transitional provisions 1. In case products and goods have been manufactured, imported, circulated on the market within the effective period stated in the decision, the notice of receipt of dossiers for declaration of conformity, the certificates of conformity and have been managed in accordance with the provisions of the Law on Product and Goods Quality before the effective date of this Law, they will continue to be circulated on the market. 2. In case the conformity assessment organizations have registered their conformity assessment activities or have been designated to serve state management in accordance with the provisions of the Law on Product and Goods Quality before the effective date of this Law, they will continue their business until the end of the effective period stated in the certificate or designation decision.
